Employees
In our experience of negotiating compromise agreements, we have never
had to charge an employee for signing a compromise agreement.
This is because the agreement will specify your employer will
contribute to the costs of the "independent adviser". The only
exceptions have been when we had to argue with the employer about the
proper level of compensation, and occasionally the employer argued that
our role was limited to approving the deal and not debating its merits.
Even in those rare cases, the increased compensation we secured more
than covered the extra legal costs.
Employers
Compromise agreements normally provide so many advantages in terms of certainty and finality, this is one bill employers - in our experience - are happy to pay, even if they have to pay the costs of their departing employee.
